Notice and Procedure for Making Claims of Copyright Infringement

Shaycom respects the intellectual property of others, and we ask our users to do the same. Shaycom may, when appropriate and at its discretion, suspend the accounts of users who may be infringing the intellectual property rights of others.

If you believe that your work has been copied in a way that constitutes copyright infringement, please notify us as described in the “Notification” section below.

Procedure

Notifications must comply with the Digital Millennium Copyright Act and other applicable intellectual property laws. Responses may include removing or disabling access to material claimed to be the subject of infringing activity.

If we remove or disable access to comply with the Digital Millennium Copyright Act, we will e-mail the owner of any affected pages so that they may make a counter notification pursuant to sections 512(g)(2) and (3) of the Act. If we receive a counter notification, we will reinstate the affected pages.

Notification

Please follow these instructions to submit a notification. To allow us to process your notification as quickly as possible, please use the suggested format.

  1. Identify the copyrighted work that you believe has been infringed. For example, "The copyrighted work is the text that appears on www.poembrew.com."
  2. List the web address (URL) of the material that you claim is infringing the copyrighted work identified in point 1. For example, “The infringing material is located at www.poembrew.com/Help”
  3. Provide your contact information so that we may contact you. An email address is preferred.
  4. Include this statement: "I have a good faith belief that use of the copyrighted materials described above on the allegedly infringing web pages is not authorized by the copyright owner, its agent, or the law."
  5. Include this statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  6. Sign the notification.
  7. Mail the notification to this address:

Counter Notification

Please follow these instructions to submit a counter notification. To allow us to process your counter notification as quickly as possible, please use the suggested format.

  1. List the web address (URL) of the material that Shaycom has removed or to which Shaycom has disabled access.
  2. Provide your contact information, including name, address, telephone number, and email address.
  3. Include a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or Clackamas County, Oregon if your address is outside of the United States), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person.
  4. Include this statement: "I swear, under penalty of perjury, that I have a good faith belief that each web page identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled."
  5. Sign the counter notification.
  6. Mail the counter notification to this address:
